Good points you raise. It's difficult to prove a negative, though. When we encounter a no-record search, we fax a notice to the client stating:
"A search of all relevant indices in the subject jurisdiction returned no results conforming to the search parameters supplied."
At that point we usually ask for additional information, such as map number, deed book/page reference, etc.
I'd say one of the biggest reasons for no-finds is mis-spelling of names, i.e., Smith for Smythe, etc. Wrong county is another big one, but nine times out of ten, if it's in a neighboring county, we'll complete the search at no extra charge as a courtesy.
