Do you have E&O?
I have E&O... I can't imaging working without it. I realize that in some places it isn't customary, but in this country anyone can sue you for anything. Even if you win, you lose (in terms of time spent and legal fees). The E&O will protect you from defense costs as well.
Do your companies claim to require it?
Some do, some don't. But whether or not they require it, doesn't mean that they won't sue you if they have a loss due to an Error or Ommission on your part.
If so, do you still get work from them even if you don't have it?
I dont' know, since I have it I couldn't say what they would do if I didn't. I don't really want to find out either.
Has a company ever refused to give you work because you don't have E&O?
Not and issue, since I carry E&O.
What kind of rates do you see for getting coverage?
I am right around $5,000/yr for an office of 6 abstractors and an administrative assistant; and that is for $1,000,000 of coverage.
Where is the best/least expensive place to get a policy? (I don't even know where to start looking.)
There are a few providers that offer the coverage, TIAC, The Merriam Insurance Agency, Title Program Administrators, just to name a few. It would be nice if we had a couple of them advertising on Source of Title, because we get this topic brought up frequently on this forum. I really can't say who is the best... it depends on your needs and expereinces.
I understand that not everyone has E&O, but I would HIGHLY recommend it. I think it is a good business practice to protect yourself and your client. Anyone can make a mistake... even the best abstractors.
