I really don't see where it is "morally or ethicly wrong" at all. Frankly I don't think morals or ethics have anything to do with it. First of all we can't regulate morality and the ethical standard is kust another part of it. Like everyone elsehas said, E&O is just plain good business sense. I know I'm not willing to put up everything I have worked that hard for. It only takes one honest mistake to put you out of business. Furthermore I don't know to many reputible businesses that don't require you to have it. My feeling is, if it is a requirement for certification, it sets you apart and hence makes you more marketable. I really would love to talk to this person.
On another note, I really think you have come up with a great product (certification), as with anything you may have to make some changed and tweek it a bit, but it is a great starting point.
