Doug, I think you are using Recodat responsibly as a suplement to the official records. In particular I like your approach of letting your clients see Recodat disclaimer. I was hoping someone would point out the responsibility of the abstractor to inform the clients of the accuracy claimed by the source. Our clients should have a right to know when we use a source other than the official records.
It is true there are errors in the official records. I found one just yesterday. It was a document that had previously been missed by another abstractor. I was sent in specifically to find this document that my client knew had been filed. It was little wonder that the previous abstractor missed the document. I would have missed it myself if I had not known the filing existed. I was able to document it had been mis-indexed and the abstractors name will be cleared.
I informed the clerk of this error and it was corrected. It was corrected in the official record but will not be corrected in any records that have already been sold in bulk. Any abstractor who relies on prior versions of the official record will miss this document and will have no defense as it is now easy to find in the official records.
