Rhode Island also has a proceedure for releasing a mortgage by affidavit. The affidavit must have copies of the cancelled check (or other proof of payment), the payoff statement and certified letter to the bank noticing them of the affidavit to release the mortgage sent 30 days prior to the affidavit. The statute creating this metod of discharge was passed in the late 1990's, but I have not yet encountered one on record.
I would have reported it and provided copies as well. I also report things like discharges from the wrong lender and assignments out of time. I would rather report someting that turns out to be nothing than miss something. I agree with Wanda, as abstractors we are responsible for reporting what's on title not deciding whether it is a problem.
