You seem to be moving in the right direction. It was good that you got an attorney involved in it. We had similar problems here in Connecticut when the building boom collapsed during the late l980's, and many people who had made partial payments to under capitalized contractors lost their money when the contractors went belly up. If your state permits prejudgment remedies, you may want to look into garnishing or attaching something of the Defendant's at the beginning of the suit. That way you will be secure in the knowledge that there will be something available to pay your judgment when judgment is entered. I am sure your attorney will advise you on all of this.
