I cannot imagine any of the above happening. That is just too much to miss without reason. But I will say I would definitely check with the clerk's office to see if any recent changes were made to this name and property owned. See if it was totally misindexed and there was no way of finding the information. I know one way that I have found documents that have been misindexed and maybe don't have the legal either - which is the way we cross-check here in Texas - is that when I run the other party - husband or wife - I locate more documents because the other name was spelled wrong in the index. I think that some abstractors tend to forget that possibility and only look on the opposite name for judgments and other liens in that party's name only and fail to double check that all the other documents have been picked up as part of the search. I have found entire current owner searches without proper addresses or entire legals given to me.
