Be careful of this...there is case law in which the courts have ruled that agreements not to change pricing even if evreyone maintains different prices still constitutes price fixing. It need not be a formal agreement. The wink of an eye or the nod of the head is all that is necessary if the gesture communicates the understanding. Any agreement formal or informal can constitute price fixing if it constitutes a restraint of trade in a free market.
