The reason that racial profiling is unlawful is because it involves presumptions and prejudices that violate constitutional rights. The authorities are required to have reasonable/probable cause to stop someone and search them. The law has come a long way since the internment of Japanese-Americans during World War II. I think I would rather live in a free society with some danger than in a society obsessed with order .
Most Americans are familiar with this concept from arrests in DWI cases. If you read the police reports, the underlying reason for pulling someone over is a traffic violation ( speeding, broken tail light, weaving). Then there is the inquiry as to why. Followed by the search of the vehicle motivated by a strong smell of alcohol in the vehicle, the appearance of the driver fumbling in the glove compartment when trying to produce an auto registry. Then there is reason for the field sobriety test and the breathalizer test.
