We've been offering this option for over a year now and it's a BIG success.
If they opt in, we waive optional fees and only charge the state mandated promulgated rates.
Consumers who opt out are charged the optional fees and are also informed that we will charge a $300 cancellation fee if it doesn't close. We really do try to get them to opt in so it's a win win.
FYI - When we invoice, we collect, even if it mean executing on a judgment and having the sheriff tag their kitchen table.
We are closing just under 90 transactions this month - not bad in this market. You just have to commit to standing your ground. We've lost a few sources of business, but in the long haul the position we have taken on cancellation fees makes us a much stronger company. I firmly believe not charging cancellation fees is a RESPA violation, a bad idea and theft of services.
