Hi, Kevin: In PA the legal description does supercede the address which is why we had the problem and needed to have the mortgage with OUR legal description satisfied.
That said, abstractors - good abstractors, not the chop shop variety - are expected to be alert to title clouds and oddities. Mistakes cause clouds and being alert to mistakes and having a detective hat on and engaged in the mark of a really good abstractor.
The best and most experienced abstractors I work with would have noticed the incorrect address on the first page and they would have noticed the other mortgage recorded on the same day with OUR address on it in error.
In PA - in western PA at least, $150 is on the high end of the pricing range for a 60 year search - one chain.
In PA - in western PA at least, receiving a copy of the mortgage with the report is not the custom, however, I noticed more and more we are starting to see them. Not a bad idea as long as it doesn't push up the cost of the search.
