I have posted before that informing the underwriters about a non-paying client is a good idea.  It will probably not help get you paid, but it may spur an audit to make sure the company is complying with their escrow practices.  Not paying vendors is a warning sign that the underwriters should pay attention to.  Not sure where I would address the letter... maybe a phone call to the underwriter just to ask who you should speak to would be a good idea.

I would agree that there is a liability issue if the work is not paid for.  That should be a big concern for the underwriter as well.
