The Constitution gives Congress the power to regulate interstate commerce. The Supreme Court held in 1944 that Congress had the power to regulate the business of insurance. The Commerce Clause even gives them the authority to regulate wholly intrastate transactions if they substantially affect interstate commerce.
I don't think there would be any constutional problem with Congress passing the health care bill.
