Well, they probably won't do any jail-time, but the court could sanction the attorneys who are abusing the system. In this case, if the homeowner has evidence that the plaintiff's attorney is not following proper procedure, he could ask the court for sanctions. I think that is more likely than getting the case dismissed on a technicality. However, it does seem that the courts are too willing to put up with these kinds of abuses and the pro se defendant's aren't really familiar enough with the system to handle it.
But, ultimately, it appears that the case is moving forward. So if there are any legitimate issues with the case, they will hopefully come out at trial. This guy will get his day in court, but it's going to take more than technicalities to win at trial - if he owes the money and he is delinquent, he is most likely going to lose his home.
