The real estate sale was complete and legal title transferred when Sam accepted consideration and delivered a deed to Andy. Sam did not have legal title to sell anything when Bruce arrived on his doorstep. Recording the deed does not affect the nature of the prior sale to Andy. Obtaining an Auditor's stamp and recording the deed merely transfer record title and create a constructive notice argument against the claims of subsequent bona fide purchasers [O.R.C. 5301.01(B)(1)(b)].
