I agree, I also think it was a good decision, consistent with their Ibanez decision, which was also the correct one. My point was not to defend the customary practice-- robo-signing too was a customary practice, so customary clearly does indeed not equate to legal. But I too have a great deal of sympathy for the buyers in these cases. Even if they made the mistake of not having an attorney look over the docs at the foreclosure sale for them, they do not deserve to lose these properties. I appreciated that the court tried to find a way around this mess for Bevilacqua, rather than just say "tough luck" as the land court judge did in the case.
