I have a question to post here, because I'm sure I have a blast coming my way. Recently hired an abstractor to do a search. This abstractor missed a mortgage on a search. We were notified by the client that this was missed. I notified the abstractor who went back out to the courthouse and yes, they did miss the mortgage in the amount of $24,000. The report was rectified and resent with no explanation from the abstractor as to why it was missed. However, this search was now considered late and we received a rejection on this order. Now the abstractor is demanding to be paid in full for the order. We have paid her for the order minus the percentage that we were deducted. Any other ideas on how to handle this? I'm not mentioning any names or states as I am just asking for feedback on how to correctly handle this, or did I handle it correctly?
