Here's a question for any of you lawyers among the SOT faithful, particularly those who practice in the area of tax law.  A client sent me the following email last week requesting an updated copy of our IRS Form W-9:


"Good Afternoon,


Above is a W-9 form for the New Year. Please fill out the W-9 form ASAP and make sure it is signed and dated with a 2016 date. I will not be able to cut any checks for work you have completed until this form has been sent back and verified with the IRS. If you have any questions or concerns please let me know.

Sincerely,

[COMPANY NAME OMITTED]"


I sent the following reply later the same day:


Dear [NAME OMITTED]:

Thank you for taking the time to reach out. Attached herewith for your review is our complete Client Information Packet, which includes a signed and dated copy of the most recent version of IRS Form W-9, our most recent rate card & coverage information and E & O insurance certificate. 

The W-9 I sent was a copy of the most recent version available for download at the irs.gov website, signed and dated sometime in November 2015, if memory serves. I also advised him of our recent address change and thanked him for his business.  He responded with this:

"I cannot provide legal advice for this form, but in our experience with other vendor’s if the first line was not filled out or not dated in 2016 the IRS would not accept the form. 

Please resend the W-9 form.


Thank you,

[COMPANY NAME OMITTED]"


Has anyone else encountered this?  Does anyone know if, in fact, the IRS requires this?  Just seems like a new and unusual request.  Thanks in advance.
