Hi Judy,

Loretta and Jay gave you some great advice. There is a lot of liability in this work. And there are companies out there that will pursue a claim on you for a mistake. Jay mentioned tricks and so on, he's right. One county I do does not reference assignments with mortgages and it can be a nightmare. I highly suggest carrying a disclaimer and provide it to all of your clients along with a copy of your E&O. 1 million is my coverage and I wouldn't go for anything less than that. Also, I do not believe that every ROD's office can claim to be error free in their data entry! Something that a company could say is your mistake may well be the ROD's mistake! They tend to misspell names or only enter info on one spouse and not both. Every county is different and you need to ask, ask, ask. There really is no substitute for experience in a title company. They can teach you so much more than what you can learn from any course offered or county level experience.

On a title report form, many companies would be happy if you used their form, but there is no standard for title form reports. I have designed several that I could send you directly. You can change it to your liking, I wouldn't mind a bit. Always happy to help out. Also, if you'd like to see a copy of my disclaimer, I could send you that too. Your best bet for legal advice is ALWAYS with an attorney!
