This is not always true. I worked for an attorney for many years and when the banks send title requests they put a disclaimer on them that the loan is not yet approved and any title work by the attorney done in advance of approval is done at the attorney's risk. I can also tell you as someone on the other end that we did pay our examiners if work had already been done, but we never got paid from the banks. I don't have a set policy myself. I bill according to the situation. If they catch me before I have completed the job, I usually bill for expenses only. If I have completed the job then I bill for it.
