You should contact the wage enforcement division of your State's Dept. of Labor to get your back wages. In most states non-payment of wages is a criminal offense. If your former employer files for bankruptcy, employee wages are given one of the highest priorities by the U S Bankruptcy Court, and if there are any assets left in the company you stand a pretty good chance of getting paid, but it may take some time.
