Thank you, George. I do want to emphasize though that when an abstractor has agreed to record a mortgage he should do it right away. My above posting does explain the problem of intervening liens and the lender's options. However, that does not absolve the abstractor from timely performance or liability for delaying performance once he has received the mortgage for recording.
My above posting is directed to those instances in which an abstractor is unable to perform the recording, and the recording has to be reassigned. Thanks again.
