Hi Pam,
Is this a law firm that you are searching for? I went on the Secretary of State website to check for Secured Title and found that there is a Secured Title,LLC. It seems to be a law firm. Katten, Muchin, Zavis, Rosenman of 401 S. Tryon St., Charlotte, NC. If this is the same company, I would make another approach to the office and ask to speak to one of the real estate attorneys. Sounds like you may have been speaking to a highly emotional employee who is probably the one who fined you the $100.00 without the knowledge of the firm. However, the law firm may have been charged the extra $100.00 as a fine from the lender because the lender had to re-draw the documents because the whole package had to be re-dated. Lawyers have to dance to the lenders music now a days. THE BANKS ARE IN CHARGE! That is probably what happened to you. You should not have to pay their fine if they sent the documents to you without your knowledge. Sounds like the little office employee was covering her mistake of not corresponding with you prior to overnighting. A communication error at the least which is not your fault. As an independent abstractor, you can not be responsible to notify every one that sends you business. That is why companies should be in contact with an abstractor when work is sent to them especially a recording in this state. If this is a law firm they should take the $100.00 hit as they are the ones who failed to communicate with you. You should take them to Magistrates Court for the cost of the court it would be worth it to get your $100.00 back + cost of court, however, a law firm will not let it get to Magistrates Court and will pay you. Obviously, you do a lot of work for them so don't threaten them with Magistrate Court unless the attorney refuses to pay you back. You probably will not get the same amount of work from them again because of this one episode especially if that employee is the one who assigns title work so go for talking to the attorney. Even that employee who talked so rudely to you, gets to take a vacation sometime lets hope. A vacation may improve her disposition. And speak up to the attorney that you get to talk to about her rudeness. They may be looking for a reason to terminate her employment for the better of their firm. Remember employers have to document reasons for termination of an employee.
