You were quite right in your response to them. In most states when a trust is created the title to the trust property (The Trust Corpus) is split. The Trustee holds the legal title. The beneficiary of the trust holds the beneficial (equitable) title to the property. Depending upon the terms, conditions and agreements contained in the trust agreement, the beneficiary may have the ability to require the Trustee to re convey legal title to the beneficiary. Whether or not that condition may exist in any given situation depends on the contents of the trust agreement, but your client needs to know about it in order to make an informed decision.
