Baloney...if the search was ordered, it is to be paid for regardless of whether the property closes. In fact, the findings of the search may be the reason the property doesn't close!  Perhaps the abstract showed a defect in title that saved a potential owner some serious heartache.  Perhaps the title work saved a bank from piling on a third or fourth mortgage that couldn't be supported from an economic standpoint.
