I am sure that a civil suit of some sort could be raised...possible unfair trade practices, whatever. However, as a practical matter unless her company has an office located in the U.S. or has appointed a statutory agent to receive process in one of the states, where are you going to sue them...India? You can attempt to sue them in a federal district court, but service of process becomes difficult if no statutory agent has been appointed. I worked for a law firm in Chicago when I was going to law school. They were representing a client who was suing someone in South Korea. Service of process had to be accomplished through the State Department.
To date I have not heard of the federal or states' Attorneys General being too terribly concerned with the matter.
I think the question is more properly directed to those parties who are outsourcing the work overseas. If they are no longer interested in current and complete information in an abstract, then it may be time for all of us to move on to more profitable ventures.
