Although this hasn't been a specific case yet that connects both the local county and the imaging company, there are some cases brewing that will make this clear. There have already been multiple cases against the aggregators who mined the data and some of these companies have very deep pockets. (Always a plus for a class action suit)
Choicepoint for example is involved in multiple suits right now as a result of their sale of identities derived from the public records. The Amy Boyer law in NJ was the direct result of a suit that held a data miner responsible.
