Actually, I missed that one. I thought it was just about E-recording. Nueces county has already put their indexes online and TitleX was selling the imagages online.
The privacy legislation will not sit well with either company. Our lead Representative for this legislation has been called to active duty but continues to work on this issue. He will be appointing a temporary substitute soon. A friend of mine will be writing the bill.
Even before the bill is passed, I believe some of the county clerks may come to their senses. Some of the worst offenders may be replaced by challengers who are bringing this issue directly to the people. The Fort Bend County Clerk is scrambling for damage control and has been ever since the people learned how reckless she has been. She recently pulled all probate records from the Internet after having consistantly lying to her constituents by telling them she could do nothing. There are several leading citizens there who are looking at the possibility of a suit.
I found the Nueces County clerk's comment that she was doing this as a service to her constituents as ridiculous on it's face. I doubt she ever asked her constituents and I know what their reaction will be once they learn. The clerk's who do this are not doing it for their constituents but for their own convenience and the profit of companies outside their community. There is no real benefit for either the county or its people.
