When I was studying to become a paralegal, we were introduced to the concept of negligence with the case of Palsgraf v. Long Island R.R., 248 N.Y. 339, 162 N.E. 99 (1928) in our torts class. It may not be a controlling case anymore, but it was an interesting study of the theory of duties to third parties as well as vicarious liability.
