My company, Title Search Services, Inc., does carry E&O insurance. I think it would be foolish to work as an abstractor without E&O insurance. The limited-liability clause on my reports may or may not stand up in a Vermont court. None of the issues of practicing law, or what constitutes title abstracting, or abstractors' liability issues have been addressed in Vermont courts, to my knowledge.
Do we hear the death rattles of some of the vendor management companies that sprang up during the huge refi boom? Is that why so many vm's are screaming at us abstractors now? There are a lot more vm's now than there were seven or eight years ago, and my guess is that some of them are going to die off or get eaten up by larger companies now that there isn't as much refi going on.
Hope the die-offs don't take too many of us with them. But boy, oh boy, am I tired of being screamed at.
