Doug: The problem I am referring to with the HUD-1 is not any error like you mention- it would be ok if there was one charge for the title on either line- but I have copies of the HUD's showing $295 for the abstract and $495 for the examination on the same case-and I also know the title examiner was not paid over $125 for this very search. I have another showing $300 for each line and the fee paid was the same $125- this is what is the violation, since no other "core title " work was performed by the settlement company- just bumping up the fees to siphon off more money from their clients. HUD says it is a violation of RESPA to do that , too, it is a section 8 violation with fines of about $7000 per occurrence - someone doesn't have the economics worked out on that aspect and it is just a nightmare waiting for someone to discover it, some have been caught and they are paying, but the abstracter is the one that looses in this deal- the client only sees what is on the lines, not knowing that only a small portion of the fees shown were actually paid for the work, the rest was just illegally taken by some greedy people.
