But if you won, couldn't you sue for the retainer to be paid by the plaintiff? Also, isn't going to cost them just as much to initiate the suit and if they know what the other party is saying is true, would they take that chance? So if you're telling the truth and have proof of this; such as in this case the cancelled check and work completed, can you really lose?
