I have a ? reagrding the E & O. Are you all required to carry E & O insurance? Is it mandated by your state? Here in my county no examiner carries it. It is the opinion of the abstractors here that is what the title insurance is for. I have been in business for 20 years and know of no examiner being held liable in my county. If examiners carry E&O than what is the liablity of the underwriter?? What is the purpose of title insurance? My liabilty is limited to the cost of the title. I stamp all my file with that and I know that in Pennslyvania EFS tried to hold an examiner liable. However because they had stamped the file with a clause to that effect. The court ruled that was where the liabilty ended.
