Thank you to everyone who answered my post. The reason that I asked this question is, it has come to my attention that there are several searchers out there that are not searching probate records. One statement I received was that there was no indication that anyone had died! So evidently they only check probate if there is a certificate of transfer or an executors deed etc. filed. The problem was.....The Grantee on the most recent deed WAS deceased and a probate had been started. Of course there was nothing filed in the recorders office, because it was still pending. Another searcher stated that there was an executors deed filed so the case was completed so why would they have to check it? Not all probate cases are handled properly. As Robert mentioned, you need to understand probate in your area & search the names on EVERY job you do. Also as was mentioned by Pete, you also can find Guardianships (you don't want an incompetent or minor signing your documents), name changes, marriage cert. etc. Bottom line is...if you don't check probate now ....you should start.
