Connecticut already has such criteria known as The Standards of Title published by the Connecticut Bar Association. They are quite extensive, and go into great detail as to what does or does not constitute an encumbrance to marketable title. They are generally accepted by attorneys and title insurance carriers as definitive of what constitutes marketable title. When attorney's draft real estate sales contracts the contracts usually contain a condition that the Seller convey title by a good and sufficient warranty deed and that defects in title will be determined by the above mentioned standards of title.
