The current title company is already on the hook for this house. They would either pay to the bank or to me, they would not pay twice. 

In Massachusetts ALL foreclosures have been ruled void by the courts, so ANY homeowner can sue to invalidate the foreclosure and get the title to the house back within three years after the foreclosure. Their hope would be that the bank's subsequent lawsuit to get their mortgage amount back again or re-foreclose would somehow be dismissed by the court. There is a woman who invalidated the foreclosure after the bank sold the house and discharged her mortgage, she invalidated the sale but wants the now invalidated mortgage discharge to remain so she gets a free house.
