Sorry Kevin, but I disagree wholeheartedly with your line of thinking. The main focus of RESPA is to prevent the consumer from paying fraudulent or trumped up fees. ANY fee listed on a settlement statement would be covered by the act and statement reflects actual payments - not what might be paid.
Enforcement is another matter entirely. HUD can't enforce a fraction of the more serious cases, but who is to know what any governmental agency will consider serious.
Rather than discourage a relatively simple way to involve the mighty HUD - let us write those letters and make the complaints and hope for the best. I see no negative consequences at all.
