There may be some question as to third parties to the closing transaction. If the title company has charged X amount of dollars and the disbursement agent has paid them X amount of dollars, the requirements of RESPA may have been satisfied. Whether the title company has not paid its subcontracting abstractors subsequent to disbursement is an open question.
