The state may not require it, but if you have a claim the state isn't going to pay it for you. E&O insurance is for your protection and it would be foolish to do work with such a high burden of liability without carrying it.
As for being "required," some clients will require it because their E&O insurer requires their subcontractors to carry their own coverage. So, you may find out later that you "need" it anyway. As for the state's requirements, only a few actually require it. Ohio recently passed a bill that requires abstractors to maintain E&O insurance.
In addition... carrying E&O projects a professional and responsible image.
