Yes... small claims court may be an option. I think that many don't pursue that because it can be intimidating if you don't have any experience with that sort of thing. I only went to small claims court once, to enforce a note I held for about $1,200. The debtor didn't show up, so I got my judgment and filed the lien. However, she soon after declared bankruptcy, then a couple years later her house was foreclosed on. I had to hire an attorney to file an answer for me. I am third in line and the sale is scheduled for next month - I don't expect to recover anything.
It would just be much easier if people would pay their debts (or invoices) and we didn't have to worry about such things. I do get your point though and the legal process is available to us.
