If the dollar amount of the claim is small enough for the small claims court's jurisdiction he does not need an attorney. He can prosecute the claim himself and the court will most likely award him his filing fees as part of his judgment. I n Connecticut the defendant has the right to transfer a small claims case to the regular docket of the Superior Court to preserve his rights to a jury trial and appeal, but the Defendant had better make certain that he wins. If he loses he has to pay not only the judgment and filing fees, but also $300.00 for the plaintiff's attorney's fees. Attorney's fees for a matter originating in the small claims court generally will not exceed that amount.
