In Ohio there is only one test for title. From the looks of the Kansas Dept. of Insurance Web site it is the same there, but I don't know for sure. It shows that they only have one category for licensing 'Title Only'.
In Ohio you have to have an affiliation with an underwriter, though an agent can usually add an employee under the same agency agreement with their underwriter with no problems. I don't think an agency could sponsor an independent abstractor and add them under their agreement, but I'm not sure. It costs the underwriter to have the agents licensed as well, and I don't think they would allow that.
It seems to be quite a loop-hole that Kansas would allow an out-of-state company to get licensed in Kansas without taking the test. Since Missouri doesn't require a test, it is really a slap in the face to Kansas abstractors. They are forcing their Kansas citizens out of business, but allowing competition from across the border to do the work with no questions asked.
Someone in Kansas really should have thought this legislation through before passing it.
