It is a very slippery area of the law. There are numerous exceptions such as those created for the utility companies and cable tv companies. There is also the issue of the Commerce clause of the U S Constitution...is this an area that may be construed to be pre-empted for federal regulation? Interesting issue if the property is located in Kansas, but the buyer may be a resident of another state buying the subject propery for investment purposes.If so, does the Kansas law constitute a valid exercise of the state's police power permitted by the Commerce clause as an exception.?
