Well, I would agree that if they have reason to believe that something was missed on a search before they issue the policy they should call to have it double checked. However, if they don't have any reason to know about it until there is a claim filed against them, that doesn't help. Would have been nice of them to call you first and give you some notice before jumping into a law suit, though.
I would agree that sometimes this job just isn't worth it. We don't make enough money to accept that kind of liability, but there are too many abstractors out there willing to work cheaper - when clients will drop you for $2.00 on a search, what can you do? Unless this industry changes for the better in the near future, it won't be worth trying to stick out the slow-down.
