To the extent that the law requires disclosure there must be compliance. If the borrower is being charged for these fees, he is entitled to an itemized accounting of that for which he is paying. Otherwise the issue of fee may be a privileged matter between the lawyer and his client.
I just attended a closing last night in which the borrower went through the HUD 1 form line by line, and demanded an explanation of each charge from the loan officer. It is a shame that there are not more borrowers like this.
