Slander is making public false statements about another person to a third party.

While you say the comments are true, the truth of the comment is merely a defense to a charge of slander.  So it is up to the individual making the statement to prove that the statement is true, and not the burden of the person being slandered to prove the comments are false.  When in matters like these (he said, she said), the burden to prove a comment is true, is not that easy of a burden to overcome.  And if there's a tie, it's still slander.
