We do the same thing when clients fall behind and have had no issues with anyone complaining nor filing libel claims against us. Simply for the fact that the account IS past due and we have the records to back it up. There is no false claim being promoted to the public, mailman, etc...
We also typically only stamp the "past due" after repeated attempts in collecting have failed. Although we have had to use this method in the past, the ink of my stamper has all but dried up, thankfully the last few years we have not had to use it.
