As Robert said, AS LONG AS THE STATEMENTS ARE TRUE, then there is no cause of action for libel. The idea of developing an equivalent of a BBB or credit report type informaton service for this industry would avoid legalities. Just remember that those who threaten to sue are using the legal system as a club to intimidate its creditors out of existence. They would actually have to go to court and PROVE to the court that the libel is really libel (i.e., untrue). And when it is proven that the statement was not libelous and that they really do owe money, then it becomes clear to the judge what the debtor is up to. Some states may sanction frivolous lawsuits. No one has ever threatened us but my response would be...go ahead, spend the money to file your complaint. We will counterclaim. See you in court. Be sure to bring all your cancelled checks (ha!).
