Sure, all we need to do is ask the loan originators to add the title search to the nonrefundable application fee. Piece of cake. Well, maybe not so much a piece of cake. It will be left to the originators to explain to the borrowers why the higher application fee.
This does not need to be the abstractors' battle alone. The title insurance companies and agents are absorbing the out of pockets, for the most part, when a loan falls through. There are exceptions, companies trying to change the industry standard by conditioning payment upon funding of the loan. This is the wrong way for the industry to move and I hope abstractors will find a way to resist this new trend.
I think this would be an excellent topic for round table discussion at the NALTEA conference in January.
