In Connecticut the disclaimer would be unenforceable because it violates the law. It does not matter if the parties agree to it. The alternative is to have the parties agree to limit liability to a reasonable amount of damages in advance. There are states that do permit the use of disclaimers, but Connecticut is not one of them.
